1. Acceptance of the General Conditions of Sale

These General Conditions of Sale govern the contractual relations between:

Our offices are located at 16 Chemin du Camping in Condrieu. Appointments are required as we often provide external services.
Our regular hours from March to October: Monday to Sunday, 9:00 a.m. to 12:00 p.m. and 2:00 p.m. to 7:00 p.m.

Any request for a quote and/or reservation from the customer implies acceptance of all of these General Conditions of Sale.
These General Conditions of Sale shall prevail over all other conditions appearing in any other document, unless prior, express and written waiver is given.

Reservation

The services offered by Intuitive Trace are by reservation only. Requesting a quote does not constitute a reservation.
The services we offer can be booked at our office or through the online booking system on our websites www.aveloviarhona.com and www.gyropodescondrieu.fr (hereinafter the "site" or "website"). Our services can also be booked on the websites of our partners, in particular the ad hoc Tourist Offices.
All reservations must be requested by the customer, accompanied by payment of the deposit and/or the entire reservation (depending on the requirements of the high season).
To be considered a "firm reservation," it must be confirmed by us via email. This will mean that the requested payment level will be validated.
Whether paid in part or in full, the final payment must be made before the start of the service, at the latest on the day the service is delivered.

Any service not paid for within this timeframe will be considered as not confirmed by the customer. In the event of a reservation via our website, a confirmation email will be systematically sent by us to confirm the final validation.
If you do not receive the confirmation email at least 48 hours before the date of your service, your reservation request is not confirmed, and in this case we invite you to contact us directly by telephone.
No reservations will be taken into account by telephone message.
The services provided by Intuitive Trace are offered within the limits of transport vehicles and drivers available on the day of payment of the reservation.

2. Services

2.0. Insurance – applicable regulations
For its various activities, the company Intuitive Trace has subscribed to insurance policies covering its professional civil liability with approved companies.

The company Intuitive Trace operates:
- A bicycle rental and EDPM activity (main activity)
- A transport activity for own account.

To provide the services offered, Intuitive Trace reserves the right to subcontract the service to professionals it has selected. In the event of subcontracting, you will be informed, and we will provide you with the name of the subcontractor concerned upon your request. Intuitive Trace will remain your point of contact.
The services offered by Intuitive Trace are those listed below, excluding all other services. The client remains solely responsible for their accommodation reservation and personal travel.

Luggage transport and bicycle repatriation services

The transport services (luggage and bicycle) consist of picking up your luggage and/or equipment at the jointly agreed location and transporting it during the day to your sleeping place or any other jointly agreed location. The service can therefore be repeated every day from stage to stage until the end of your journey, within the limits of the areas served by Intuitive Trace.
Booking in our offices or on the aforementioned websites allows you to reserve the date and location for our services to collect your luggage, as well as the drop-off location. When booking, it is imperative to specify the number of pieces of luggage to be transported. Similarly, regarding the bicycle to be returned, you will need to specify the desired meeting point as well as the type of bicycle and its value. Depending on the criteria, we may decline to collect your equipment. We invite you to contact us before making your request.
In the absence of complete information from the client, Intuitive Trace will not be able to provide the service.
The luggage can be either a suitcase, a sports bag or a backpack.
Baggage must weigh a maximum of 15 kg, be in good condition, closed, and in a single volume. Any additional bag or equipment is considered extra baggage and will be charged as such.
In case of excess weight, Intuitive Trace will ask the customer to take the necessary steps to comply with the 15 kg limit. This may involve transporting an additional bag at the current rate communicated to you for your first bag.
Baggage must contain only accessories, clothing, no perishable goods, no currency, no valuables, no illicit products, no animals, no explosives.
The customer undertakes that their luggage does not contain any valuable items (over €50), fragile items or medication.
If your baggage contains valuable or particularly fragile items, we invite you to declare it in advance, before transport, so that the necessary arrangements can be made if necessary.

The luggage to be transported must be made available to us by 8:00 a.m. in the luggage room of your accommodation or any other location provided by the accommodation. It will be delivered to you at the accommodation indicated by you before 6:00 p.m. In case of absence, it will be left in the luggage room of the accommodation or in any other location reserved for this purpose by the accommodation.
The baggage to be transported must be clearly identified by means of a separate piece of paper clearly bearing the following information:
• Mention: INTUITIVE TRACE,
• Your first and last name,
• Your reservation reference (the e-ticket sent when you ordered)
• Your mobile phone number,
• the number of bags to be transported (especially if you are in a group).
Any baggage not clearly identified will not be transported and the customer will remain responsible for their baggage.
Intuitive Trace is responsible for the baggage during transport. The customer remains responsible for his/her luggage, particularly in the event of theft or damage at the accommodation, the pick-up or drop-off location, and particularly in the luggage room at this location (pick-up or drop-off).

Bicycle repatriation reservations must be booked online. The e-ticket provided with your request must be attached to the bicycle for collection.
The e-ticket for bicycle return includes all accessories that must be returned with the bicycle. Any other accessories not listed on the reservation must be removed.

3. Operation of online booking (Addock and Open Systems software from Alliance Réseaux).

Services related to cycle touring extend along the ViaRhona, exclusively on the central Vienne-Avignon section.
Online booking is possible for the following services: bicycle rentals, luggage transport, bicycle delivery and collection.

The locations served by Intuitive Trace are the following accommodation locations: lodges, campsites, hotels and guest houses, excluding all other locations. Also taken into account for the repatriation of bicycles are the SNCF TER stations on Line 5 Vienne-Avignon.

A summary of the selected services with the associated price will be sent to you by email upon receipt of your request.
You will then have to make the payment online, at least 50% of the total amount of the requested service.
Registration of the reservation request implies acceptance of all of these General Terms and Conditions of Sale. The data recorded by the aforementioned computer system constitutes proof of transactions carried out on the site between Intuitive Trace and its customers. By correctly entering your data, you will receive a copy of your transaction by email.
No reservation will be taken into account without payment.
In case of payment, Intuitive Trace confirms the acceptance of your reservation by email summarizing your reservation as well as its payment to the email address you provided. IN THE ABSENCE OF THIS CONFIRMATION EMAIL, YOUR SERVICE IS NOT COMMITTED.

4. Rates

All our rates are available on our website and upon request for a quote for your personalized service. Prices are expressed in euros.
The prices indicated include VAT at the rate set by current regulations.
The total price indicated in the booking summary is the final price, unless there are any new items on the day of the service: additional baggage(s) and/or bicycle(s), excess baggage(s), baggage(s) requiring specific handling or care. This price includes the total price for the service(s) booked with the details of each service.
Intuitive Trace reserves the right to modify its prices at any time, excluding prices for services already booked.

5. Means and methods of payment

The following payment methods are accepted: Cash, bank transfers, bank cards (Visa and MasterCard).
Services are payable no later than 8 calendar days before the start of the service. No service is definitively reserved before payment. Any service request not paid within this timeframe will be considered unconfirmed by the client and will be canceled.
In the case of payment by bank card or transfer, the reservation is only considered confirmed once the payment or transfer has been accepted and the reservation has been confirmed by Intuitive Trace.
NO RESERVATIONS BY CHECK.
Intuitive Trace reserves the right to refuse or cancel any new reservation from a customer with whom a dispute exists.

6. Cancellation terms and costs – Right of withdrawal

The customer has a period of fourteen (14) days from payment for the service to exercise his right of withdrawal unless the service has been fully performed before the end of the withdrawal period and the customer has, prior to the performance of the service, expressly waived his right of withdrawal. If the entire service is not performed, the client pays the professional an amount corresponding to the service provided until the communication of his decision to withdraw.

Without prejudice to the withdrawal period where applicable, any reservation may be cancelled by email, without justification by the customer under the following conditions:
• At least 15 days before the service is performed: Deposit (50%) lost.
• Less than 15 days before the service: full payment is due.
Following the cancellation conditions indicated above, any refunds will be made using the same payment method used by the customer, unless the customer agrees to any other method. The customer will provide all necessary data to the Intuitive Trace service.
For any refund, a fee of €15 will be retained from the customer's account, in addition to the amounts due for compliance with the cancellation deadline.

Any modification to the service will incur a fee of €15. A modification of the service by Intuitive Trace to meet the customer's new request cannot be considered a cancellation of the service.

7. Force majeure

Intuitive Trace shall not be held liable, or deemed to have failed in its obligations, for any delay or non-performance when the cause of the delay or non-performance results from a case of force majeure as defined by the case law of the French courts. In addition and within the meaning of this contract, the Service Provider's inability to perform due to bad weather, strikes, roadworks, traffic congestion and road accidents, and any events beyond Intuitive Trace's reasonable control, shall be considered as cases of Force Majeure.
In the event of force majeure, Intuitive Trace will inform the customer as soon as possible and will make its best efforts to meet its obligations, but they may be delayed or cancelled without compensation.

8. Applicable law – language of the contract

These general terms and conditions of intervention are written in French. They are subject to French law. The fact that Intuitive Trace or the client does not avail themselves at any given time of any of the clauses herein cannot constitute a waiver of the right to avail themselves of these same clauses at a later date.

9. Complaints

10. Disputes - consumer mediation

In the event of a dispute between Intuitive Trace and the client, an amicable solution must be sought before any legal action.
In the event of a dispute with Intuitive Trace, the customer may use the CNPM MEDIATION CONSOMMATION mediation service free of charge.
In the absence of an agreement between the parties, the dispute may be brought before the competent court.
Please note that recourse to mediation is only possible if the claim has not been previously examined by a judge or other mediator and subject to having previously attempted to resolve the dispute directly with intuitive Trace by means of a written complaint. The request for mediation must be made within the last 12 months of the written complaint. Mediation interrupts the limitation period.

11. Protection of personal data

The personal data collected from the customer is necessary for the performance of the service and the establishment of the corresponding invoice.
The customer's personal data is collected via the website or directly from our services and may be subject to computer processing intended for:
•carry out operations relating to customer management concerning: the provision of services; invoices; accounting and in particular the management of customer accounts;
• sending our newsletter containing information on our news;
• the development of commercial statistics and/or to enable the development of the content of our services;
• monitoring customer relations and customer situations, conducting satisfaction surveys, managing complaints and any subsequent questions from customers;
• management of requests relating to your rights concerning the processing of your personal data;
• management of unpaid debts and disputes;
• management of people's opinions on the services offered.
The personal information collected is necessary to process your requests.

The recipient of the data is Intuitive Trace and its subcontractors for the execution of a service (transport service for example, etc.). This subcontractor is indicated to the customer when booking the service concerned. The retention period of the data is limited to the duration necessary for the operations for which they were collected and in compliance with the regulations. In this regard, customer data is kept for the duration of the contractual relationship plus five (5) years, without prejudice to retention obligations or limitation periods.

In accordance with the regulations, you have the right to access, rectify, erase, limit the processing, and the right to portability of information concerning you, which you can exercise by contacting the data controller:

You have the right to withdraw your consent to the processing of your data at any time.

The requirement to provide your data is purely contractual and conditions the performance of the service. The client may object, free of charge and without justification, to the processing of data concerning them. This opposition, like the failure to provide mandatory information (marked with a * in the collection form), will, where applicable, result in an inability to process the client's requests. The data is not subject to automated decision-making, including profiling. In the event of a complaint regarding the processing of your data, you may contact the competent supervisory authority.
